This course examines both the statutory requirements and the common law principles which apply to the employment relationship from hiring to termination. Applicable provincial legislation will be thoroughly reviewed with emphasis and in-depth analysis on the application of the Human Rights Code and the Employment Standards Act. Practical case based assignments explore the range of common law principles governing dismissal including notice periods, wrongful and constructive dismissal. In regard to labour law, students explore the role of the trade union, the collective bargaining process, collective agreements and the grievance process. The course examines issues involving determination of forum for resolving employment law disputes either before a statutory tribunal or via the court process.
