This course examines procedures governing provincial offences in Ontario. Students explore the regulatory nature of this area of law and identify the quasi-criminal nature of its proceedings. The course examines the substantive law found in a variety of statutes, exploring the elements of the offence created and its defenses, including the Compulsory Automobile Insurance Act, Liquor Licence Act, Environmental Protection Act, Occupational Health and Safety Act, Trespass to Property Act, Blind Persons Rights Act, Municipal By-Laws, with particular emphasis on the Highway Traffic Act. Students develop strategies to effectively advance arguments in support of the prosecution or defence under various offence-creating provincial statutes.
