This course examines the nature and mandates of administrative tribunals created under provincial or federal enabling statutes. Students assess issues of procedural fairness in employing the rules of natural justice and the Statutory Powers & Procedures Act. Students examine enabling legislation and the scope of administrative agency and tribunal authority. Case exercises develop student ability to interpret cases. The course examines process and procedures followed during the pre-hearing stage and during the hearing process. Students review application of Charter protections and remedies as well as the role of the judiciary and the nature of judicial review.
