POLICY It is the policy of St. Clair
College to adopt and enforce the following Copyright Guidelines for Ontario
Community Colleges as they relate to reproduction and translation: COPYRIGHT GUIDELINES Scope: The issue of copyright as it relates to
reproduction and translation is divided into sections. Examples of media reproduction relevant to
each section are used for clarification only and do not represent the entire
list of activities associated with each section. These guidelines apply to both print and non-print media and are
in accordance with the Canadian Copyright Act (R.S.C., 1970, C. c-30, as
amended). 1. PIRATING COPYRIGHTED MATERIAL Reproduction
of material which is rented, borrowed, or on preview as well as the off-air recording
of television programming, are infringements of copyright, unless the
permission of the copyright holder has been granted. The copyright holder is being denied rightful revenues from the
sale or rental of this material. 1.1 Guidelines a) Borrowed or rented materials, or media
available through preview, will not be reproduced unless written permission has
been received from the copyright holder or his/her legal representative. b) Copyrighted programs will not be recorded

2. REPRODUCING SINGLE OR
MULTIPLE COPIES
Reproduction
(one or more copies) of any copyrighted material, even if the original has been
purchased by the College is an infringement of copyright unless the permission
of the copyright holder has been granted.
Unauthorized reproduction of copyrighted materials deprives authors,
producers, etc. of earned revenue from increased sales of their material.
2.1 Guideline
a) Written permission to duplicate will be sought
at a negotiated price (where appropriate, it si recommended that this
negotiation take place at the time of purchase). Otherwise, copying will not be done.
2.2 Examples
a) 35 mm slides
b) videotapes
c) audiotapes
e) journal articles
f) chapters from books
g) overhead transparencies
h) illustrations
3. MEDIA FORMAT TRANSFER
There are
many situations in which the "message" or information which would be
of great value to the learning process is not available in a format suited to
the learning environment. For example,
the information may be in a medium incompatible with the College's equipment,
or in a format difficult to distribute or display in a class situation. Nevertheless, to make a copy of copyrighted
work without the permission of the copyright holder, even if the sole intent it
to improve the distribution method of that message, is still an infringement of
copyright.

3.1 Guideline
a) Permission from the copyright holder must be
obtained to reproduce copyright works in any format.
3.2 Examples
a) book illustration to 35mm slide
b) videotape format A to videotape

d) 16mm film to videotape
4. ARCHIVING THE MASTER
Many of
the resources being purchased today, especially in the field of non-print
media, are extremely expensive, yet easily susceptible to damage. In some cases, repair is impossible and the
information is list unless a replacement copy is purchased. To protect against such damage, some
Colleges may wish to make a circulation copy from the master and store the
master in a safe place. Nevertheless,
this is an infringement of copyright.
4.1 Guideline
a) Written copyright clearance must be negotiated
with the copyright holder in order to make one copy in the agreed upon format
and to store the master material. The
copy must be destroyed within the agreed upon number of years after the
original work was purchased or renegotiation with the copyright holder must
take place.

5. USING THE WHOLE OF PART OF COPYRIGHTED
MATERIAL AS PART OF A NEW PRODUCTION
Whether
or not the new production is for sale or free distribution, it is a violation
to use the whole or parts of copyrighted materials without the permission of
the copyright holder.
5.1 Guideline
a) Written
permission must be secured to use copyrighted material in any new production. (Quite often these rights are granted upon
request at little or no cost).
5.2 Example
a) illustrations
b) articles
c) printed manuals
d) anthologies
e) book chapters
6. LANGUAGE TRANSLATIONS
One of
the rights of the copyright holder is that of publishing a translation of
his/her work. Therefore, to translate
the whole or part of a work without the permission of the copyright holder is
in violation of the copyright law.
6.1 Guideline
a) Written permission will be sought from the
copyright holder to translate any copyrighted material in whole or in part.
6.2 Example
a) books
b) journal articles
c) graphics and scripts in
audiovisual productions
